TRADEMARK MATTERS IN INDONESIA

A. The Trademark Search.

This service is provided to inform client (s) of any similar mark (s) with the one that they are going to be applied. This research includes full availability search, identical search and status research.The searching process will be delivered within 4-5 days working days. The search report will include the details of the cited mark found, i.e.:
- Applicant name &. address
- Class
- Representation of mark
- Recent status
- Applicant / registration Nos. and date
- List of goods / services
- Validity

B. The requirements and procedures for trademark filing in Indonesia

1. Simply Executed Power of Attorney and Declaration (enclosed).
One pair of duly executed Power of Attorney and one Declaration are for one mark in one class only. The Power of Attorney and Declaration need no legalization or notarization.
2. The information of the mark (s), namely :
- Applicant's name & address
- Class
- List of goods / services
- 30 pcs. Representation of mark with min. size 2x2 and max. size 9 x9cm

3. Priority documents and its English translation (if any)
It normally takes about 18 - 24 months as from the filing date before the relevant certificate is issued by the Registry.

C. Requirements for Representing an Opposition and / or Rebuttal action :

1. The simply executed Power of Attorney
2. Copy of trademark certificate of registration in the name of client as the basis of opposition argument.
It is preferable if client could also provide us with the supporting materials such as Photographs, brochures or pamphlets to prove the use of client's mark (if any).

D. The Procedures and Requirements for Change of Name and Address :


1. The executed Power of Attorney
2. The Deed of Change of Name duly legalized by Indonesian Embassy in relevant country

E. The procedures and requirements for Recordai of Assignment :

1. The Executed Power of Attorney and Declaration
2. The Deed of Assignment legalized by Indonesian Embassy in relevant country.
Please note that the Power of Attorney and Declaration need no notarization or legalization.

Please note that if the required -documents for every matter are not in English, -therefore they should be translated into English by Sworn translator in the relevant country.

PATENTS

WHAT WE HAVE

Indomark experiences in handling patent matters (PCT National Phase, National Patent Application, and Petty Patent) not only in Indonesia but also abroad. 6PI also experiences in making harmonious cooperation with great clients and colleagues all over the world.

REQUIRED DOCUMENTS
To conduct a patent search, we need the fallowings:
1. Patent application/registration
  number; and/or
2. Patent title; and/or
3. Abstract of the patent.
To file a patent application in Indonesia, we need the following documents:
1. Original executed Power of Attorney and Assignment of Rights;
2. Copy of specification (in English) including description, claims, abstract and drawings (if
  any);
3. Copy of priority document (if any) and its English translation;
4. Especially for PCT National Application, we require:
 
  a. Copy of PCT documents such as WIPO International Publication;
b. Chapter I: Copy of form PCT/ISA/210 and PCT/RO/101.
c. Chapter II: Copy of form PCT/ISA/210, PCT/IPEA/409, PCT/IPEA/401 or PCT/IB/332.
 
To pay patent annuities, we require the following documents:
 
1. A copy of the patent certificate and its cover page;
 
2. A copy of previous patent annuity payment form (receipt) if the first annuity was paid.
DEADLINES
1. To enter PCT National Phase
  Application:
  a. Chapter I: 30 months as from the
    1st priority date,
  b. Chapter II: 31 months as from the
    1st priority date.
2. To enter a patent application claiming priority based on Paris Convention Treaty: 12
  months as from the 1st priority date.
3. To file a request for substantive examination:
  a. National Patent Application: 3 years as from the national filing date,
b. PCT National Phase: 3 years as from the international filing date.
4. To pay the 1st annuity fees:
  one year as from the granted date. But if until this deadline the patent certificate is not issued yet, the deadline is extended until three months as from the date of the certificate issuance.
